We submitted a perpetual water rights application permit to TCEQ for the SCD reservoir in October 2012. We were notified that our permit was "administratively complete" in January 2013. Water use permits are currently backlogged, and our permit is still under review. We discuss the status and timing of our permit with the TCEQ project coordinator every few weeks. We are hopeful the review will be completed in 2016.

There is no change to the policy. Only the terminology was revised to reflect current accounting procedures. The original language in section 6.02

"… a monthly maintenance charge (the "Maintenance Charge"), and any other assessments or charges hereby levied…"

now reads

… an annual Property Maintenance Assessment and any other Special Assessment or charges levied …

The purpose and intent of the policy is the same, and any future increase in maintenance fees still requires approval of a majority of the property owners.

Please call the Animal Control Division of the Kendall County Sheriff’s office at the Animal Control Hotline, (830) 247-9721, ext. 538  (Terry Bowen). This division is trained to handle such situations and responds promptly. Once this contact is made, please advise the Board by calling the POA message line at (830) 537-9993 or by sending an e-mail to the POA’s Vice-President of Standards via the contact page. The Board will maintain a log of such incidents to determine the severity of the problem and to seek appropriate solutions with the cooperation of the County.

In 2008 and 2009, we completed three separate phases of interim repairs which have been certified and documented with the TCEQ. We believe the dam is structurally sound with an expected life of 10 -12 years before additional work is required under normal circumstances. However, previous inspection showed that the dam in tilting slightly forward. Extremely heavy flooding could cause earlier failure. We have been periodically using GPS data to detect dam movement.

We signed two contracts for additional work this year. The first is a visual inspection of the base of the dam to see if there has been any additional deterioration since the last inspection in 2009. The second study will update the available options for permanent repair to restore the dam integrity to as built or like new condition. This study will also update previous estimates for the cost of these repair. Both studies will be completed by mid-year.

The Waterfall has been completely redesigned and filled with water out of Spring Creek. The height of the waterfall was reduced significantly which decreases the amount of water evaporation hence using less water than landscaping. In addition the amount of exposed surface water is minimal. The water for this feature is covered by rock and other media which significantly reduces evaporation. It is intended to maintain the volume of water necessary to operate the feature using the rain water harvesting system from the roof of the mailbox facility.
